Droit d’auteur et numérique : où en est-on ?

"[...] Le passage du papier au numérique modifie considérablement la manière dont les oeuvres sont reproduites, diffusées, exploitées. Dans ce mouvement perpétuel des technologies et des usages, le droit semble avoir du mal à s’adapter. Celui qui régit l’exercice du droit d’auteur dans le numérique est fait d’un empilement des lois partielles et récentes, sans grande cohérence. De fait, les interprétations qui en sont données peuvent être contradictoires et évolutives dans le temps. Aux professionnels de l’édition qui demandent ce qui est légal et ce qui ne l’est pas, les juristes ne peuvent pas toujours apporter de réponse tranchée. [...]"

Un extrait : " Numerous providers are using the work of authors, publishers and broadcasters without paying for it. Over the long term, this threatens the production of high-quality content and the existence of independent journalism. For this reason, we advocate strongly urgent improvements in the protection of intellectual property on the Internet".

Reuse of material in the context of education and research

Ce document, réalisé par la SURF Foundation et paru en néerlandais en 2008, est désormais disponible en anglais.

"[...] The rise of the Internet and other new ICT tools have led to drastic changes in the options for distribution and reuse. These changes demand a reorientation in the rules for sharing educational and research materials.

Since sharing educational and research materials is high on the agenda of Dutch higher education and research institutions, SURFdirect and Creative Commons examined the different Open Content licences that are available and that will make clear to reusers what they are permitted to do with material held in repositories.

SURFdirect has indicated that the choice of licence must not create barriers to the future use of educational and research material, that it can be applied at both research universities and universities of applied sciences [hogescholen], and that this can in fact be done in 80% of cases, this report recommends using the most liberal Creative Commons licence for textual output:

On the basis of the Creative Commons Attribution 3.0 Netherlands Licence, users of the licensed work are permitted to copy it, distribute it, and pass it on, and produce derivative works and distribute them on condition that the work is attributed to its author. This licence freely permits commercial use and derivative works as long as users comply with the requirements regarding attribution. These comprise not only giving the name of the author but also the obligation to clearly designate derivative works as such. [...]"

Dans ce billet, Brian Kelly passe en revue les "termes et conditions" d'utilisateur du moteur de recherche (non sans humour):

[...] If you make results from Wolfram|Alpha available to anyone else, or incorporate those results into your own documents or presentations, you must include attribution indicating that the results and/or the presentation of the results came from Wolfram|Alpha. Some Wolfram|Alpha results include copyright statements or attributions linking the results to us or to third-party data providers, and you may not remove or obscure those attributions or copyright statements. Whenever possible, such attribution should take the form of a link to Wolfram|Alpha, either to the front page of the website or, better yet, to the specific query that generated the results you used.

So if I ask Wolfram|Alpha what 1+1 is, if I published the result ‘2′ I must provide a link back to Wolfram|Alpha. And if I ask “What were the dates of the second World War?” I need to provide a similar link before using the answer “1 September 1939 to 2 September 1945″. [...]"
